These Terms of Service (“Terms”) govern your use of the Calk application (“App”). The App is provided by Calk (“we,” “us,” or “our”) and is designed to help you log food, estimate nutrition, and understand weight and eating patterns. By using the App, you agree to be bound by these Terms. If you do not agree with these terms, please discontinue using the App.
1. Acceptance of Terms#
Your use of the App signifies your acceptance of these Terms. We may update these Terms at our sole discretion. Changes take effect when posted in the App, on our website (calk.me), or when we notify you through reasonable means. Continued use of the App after such updates indicates your agreement to the revised Terms.
2. Eligibility#
The App is intended for adults. If you are under 18, pregnant, managing a medical condition, have a history of eating disorders or disordered eating, or are following a medically prescribed diet, use the App only with guidance from a parent, guardian, or qualified healthcare professional.
3. License#
We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes, subject to these Terms. You may not copy, modify, distribute, sell, lease, reverse-engineer, or extract the App’s source code, unless permitted by applicable law.
4. Intellectual Property#
All content, trademarks, and materials in the App (excluding user-provided data) are owned by or licensed to Calk and protected by copyright, trademark, and other laws. You may not use our intellectual property without prior written consent, except as allowed under these Terms.
5. Fees and In-App Purchases#
- Free features: Food logging with the Food Constructor, your daily calorie and macro analysis, weight tracking with the weight-trend chart, and your first nutrition report are available free of charge, with no time limit.
- Subscription: Continued access to the deeper analytics, report regeneration and periodic check-up reports, and advanced insights and controls requires a paid subscription.
- Free trial: New users receive a 30-day trial with full access to the paid features. No payment method is required to sign up.
- Billing: Subscriptions are offered as in-app purchases through the relevant app store (e.g., Apple App Store or Google Play Store). Current prices and terms are shown in the App. Billing, renewal, and refunds are handled by, and subject to, that app store’s policies, which you should review before purchasing.
6. Health Disclaimer#
The App offers general recommendations for food tracking, nutritional information, and weight loss management based on your input. We are not a medical organization and do not provide medical advice, diagnosis, or treatment. Consult a qualified healthcare professional before making significant dietary or lifestyle changes, especially if you have pre-existing health conditions. Use of the App is at your own risk.
7. User Data and Privacy#
We collect and process personal data according to our Privacy Policy. By using the App, you consent to this collection and processing. You are responsible for ensuring the accuracy of data you provide, such as food intake or personal metrics.
8. Termination#
You may discontinue using the App at any time by uninstalling it. We reserve the right to suspend or terminate your access to the App, in whole or in part, at our discretion, with or without notice, for reasons including violation of these Terms, legal obligations, or prolonged inactivity.
9. Disclaimer of Warranties#
The App is provided “as is” and “as available,” without warranties of any kind, express or implied, including fitness for a particular purpose, accuracy, or uninterrupted operation. We do not guarantee that the App will meet your expectations or be error-free.
10. Limitation of Liability#
To the fullest extent permitted by law, Calk, its developers, and affiliates are not liable for any direct, indirect, incidental, or consequential damages arising from your use of the App. You use the App at your own risk.
