These Terms govern the Calk application (the “App”) and related services at calk.me. Calk is provided by Eli Petukhov, Nahariya, Israel (“Calk,” “we,” “us”). Contact: support@calk.me.
By using the App, you agree to these Terms. If you do not agree, do not use it.
1. Eligibility#
Calk is intended only for people aged 18 or older. Do not use the App or create an account if you are under 18.
2. Wellness product, not medical care#
Calk is a general wellness and self-tracking tool. It is not intended to diagnose, prevent, monitor, predict, prognose, treat, or alleviate disease, and it is not a substitute for a physician, registered dietitian, mental-health professional, or other qualified clinician. Do not use Calk for a medical diagnosis, treatment decision, emergency, or clinical monitoring.
Calories, nutrients, portions, activity expenditure, weight trends, and targets are estimates based on the information and reference data available. Foods, recipes, labels, bodies, and sensors vary. Calk does not guarantee that an estimate is complete, accurate, or suitable for your circumstances.
Calk is not an allergy, intolerance, contamination, or food-safety checker. Check the actual product label and contact a qualified professional or manufacturer when safety depends on an ingredient or nutrient value.
Consult a qualified healthcare professional before making a significant dietary, weight, exercise, or medication-related change, especially if you are pregnant or breastfeeding, have a medical condition, follow a prescribed diet, or have a current or past eating disorder or disordered-eating symptoms. Stop using the App and seek appropriate help if tracking causes distress or unsafe behavior. For an emergency, contact local emergency services.
3. Your responsibility#
You decide whether and how to act on information shown by Calk. Keep independent copies of information you need, review important estimates, and use the App lawfully. You are responsible for the accuracy of information you enter and for securing your device and account credentials.
4. License and acceptable use#
We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the App, subject to these Terms and applicable law. You may not abuse the service, interfere with its operation or security, access it by unauthorized automated means, or copy, distribute, sell, lease, or reverse-engineer it except where applicable law expressly permits.
The App, brand, original content, and software are owned by or licensed to Calk. These Terms do not transfer intellectual-property rights to you. Your own data remains yours.
5. Availability and changes#
The App may change, be interrupted, or discontinue. We do not promise that every feature will always be available. We will use reasonable efforts to provide notice of material changes that negatively affect paid access. Security, legal, or technical changes may be made without advance notice when necessary.
We may update these Terms. Material changes will be posted with a new update date and, where appropriate, additional notice. Changes do not retroactively remove mandatory consumer rights.
6. Free and paid features#
Calk may offer free features, promotional access, trials, subscriptions, or one-time purchases. The App and the relevant app-store purchase screen show the current price, duration, included features, trial terms, renewal terms, and any action needed to cancel before you authorize payment. We do not charge you without app-store authorization.
Free or promotional access may be limited to one grant per person. Creating a new account, reinstalling, or signing in through a different provider does not by itself create a new entitlement.
App Store or Google Play terms govern payment processing, automatic renewal, cancellation, and store-administered refunds. You manage or cancel a subscription in the relevant store. Nothing here limits refund, withdrawal, warranty, or other rights that applicable consumer law makes mandatory.
7. Privacy and deletion#
We process personal data as described in the Privacy Policy. Using the App does not by itself constitute consent where applicable law requires a separate choice.
You may stop using Calk at any time. Settings → Delete account deletes your account and on-device nutrition history as described in the Privacy Policy. Uninstalling alone does not necessarily cancel an app-store subscription or delete a server-side account.
We may suspend access when reasonably necessary for security, fraud prevention, legal compliance, material breach of these Terms, or protection of other users. Paid rights and mandatory notice requirements remain subject to applicable law and app-store rules.
8. Disclaimers#
To the extent permitted by law, Calk is provided “as is” and “as available.” We do not promise uninterrupted or error-free operation, perfect estimates, or fitness for a particular medical, dietary, or commercial purpose.
These disclaimers do not exclude statutory warranties or consumer guarantees that cannot lawfully be excluded.
9. Liability#
To the extent permitted by law, Calk is not responsible for indirect, incidental, special, or consequential loss arising from use of, or inability to use, the App. We do not exclude or limit liability where doing so is prohibited, including liability that applicable law does not allow us to exclude for fraud, intentional misconduct, gross negligence, personal injury, or mandatory consumer rights.
10. Governing law#
These Terms are governed by the laws of Israel, without regard to conflict-of-law rules. If mandatory consumer law in your country gives you additional protections or a right to bring a claim in local courts, these Terms do not take those rights away.
